The offense of drugged driving is defined in Section 39:4-50 of the New Jersey Revised Statutes. Under Section 39:4-50, “[a] person who operates a motor vehicle while under the influence of . . . [a] narcotic, hallucinogenic or habit-producing drug . . . shall be [guilty of DUI].” Drugs covered under the statute include (but are not limited to):

  • Cocaine
  • Ecstasy
  • Heroin
  • Ketamine
  • Marijuana
  • Methamphetamine
  • Prescription drugs

Regardless of your level of impairment, if you get convicted of driving under the influence of drugs in New Jersey, you will face the same penalties as someone convicted of driving with a BAC of 0.10 or above, with some exceptions. These are greater than the penalties for driving with a BAC of 0.08 percent. If convicted, you can face:

  • Up to 48 hours at an Intoxicated Driver Resource Center
  • Up to a 12-month driver’s license suspension
  • Up to 30 days in jail
  • Other penalties imposed at the discretion of the court
